Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of the products, services, and technologies ("Products") provided by Vyklow Analytics Pty Ltd ABN 22 688 212 795 ("Vyklow", "we", "us", "our"). This policy is designed to protect our customers, our systems, and the broader community from unethical, irresponsible, and illegal activity.

This AUP forms part of our Terms of Service. By using our Products, you agree to comply with this policy.

2. Customer Accountability

You are responsible for your own actions and the actions of anyone using our Products with your permission, including your employees and authorised users. This responsibility extends to anyone using our Products as a result of your failure to implement reasonable security measures.

If you are using our Products on behalf of an organisation, you agree to ensure all users within your organisation comply with this policy.

3. Fair Use and Usage Limits

Our Products are licensed on a per-seat basis. Your subscription entitles you to the number of users specified in your plan. Exceeding your licensed user count may result in additional fees or service restrictions.

We provide our services with the expectation that your usage will be consistent with normal business operations. If your usage is deemed excessive or places unreasonable load on our systems, we may contact you to discuss your needs or apply capacity restrictions.

4. Prohibited Activities

4.1 Illegal Activity

You must not use our Products to:

  • Violate any applicable law or regulation
  • Infringe intellectual property rights of any third party
  • Distribute illegal content
  • Engage in fraud or deceptive practices

4.2 Harmful Behaviour

You must not use our Products to:

  • Harass, abuse, threaten, or intimidate others
  • Engage in hate speech or discrimination
  • Publish content that incites violence or threatens safety
  • Stalk or monitor individuals without proper authorisation

4.3 Technical Abuse

You must not:

  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Introduce malware, viruses, or other harmful code
  • Conduct denial-of-service attacks or network interference
  • Reverse engineer, decompile, or attempt to extract source code
  • Circumvent security controls or access restrictions
  • Use automated means to access our Products in ways that exceed normal usage or impair performance

4.4 Spam and Unsolicited Communications

You must not use our Products to:

  • Send unsolicited bulk messages or spam
  • Operate unconfirmed mailing lists
  • Use purchased contact lists for unsolicited communications

4.5 Impersonation

You must not:

  • Impersonate Vyklow or represent a false business relationship with us
  • Impersonate other users or third parties

5. Product-Specific Rules

5.1 Vireo Sentinel

Vireo Sentinel is an AI governance platform that monitors AI tool usage within organisations. Due to the sensitive nature of workplace monitoring, the following additional rules apply:

Employee notification: You must notify employees that AI usage monitoring is in place. Many jurisdictions legally require this notification. You are responsible for complying with all applicable workplace monitoring laws in your jurisdiction.

No discriminatory use: You must not use monitoring data from Vireo Sentinel to make discriminatory employment decisions or to target individuals based on protected characteristics.

Personal devices: You must not deploy Vireo Sentinel on personal devices without the explicit, informed consent of the device owner.

Data confidentiality: You must not share monitoring reports or data outside your organisation without proper authorisation and appropriate data protection measures.

No tampering: You must not tamper with, disable, or circumvent the Vireo Sentinel browser extension to avoid detection or alter monitoring results.

Legitimate business purpose: Monitoring must be conducted for legitimate business purposes such as data security, compliance, and governance—not for general surveillance or employee harassment.

6. Enforcement

If you violate this policy, we may, at our sole discretion:

  • Issue a warning
  • Temporarily suspend your access
  • Permanently terminate your account
  • Report violations to law enforcement
  • Take legal action to recover damages

We are not obligated to provide advance notice for violations that:

  • Pose immediate risk to our services or other users
  • Are clearly illegal
  • Violate the rights of third parties
  • Involve fraud or security threats

To the extent permitted by law, no credit or refund will be provided for service interruptions resulting from violations of this policy.

7. Reporting Violations

If you become aware of any violation of this policy, please report it to us at support@vyklow.com. We will investigate reports and respond within 5 business days.

When reporting a violation, please provide as much detail as possible, including the nature of the violation, any evidence or documentation, and contact information for follow-up.

8. Changes to This Policy

We may modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of: the date you use our Products after we publish the revised version, or 30 days after we publish the revised version.

Material changes will be notified via email or prominent notice within our Products.

9. Governing Law

This policy is governed by the laws of Western Australia, Australia. Any disputes shall be resolved in the courts of Western Australia.
